1. Introduction and Acceptance of Terms

These Terms of Service, referred to in this document as the Terms, constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Auto Veteran, referred to in this document as the Company, we, us, or our, concerning your access to and use of the website located at www.autoveteran.tech, together with any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected to it, referred to collectively as the Service.

By accessing or using the Service in any manner, including but not limited to visiting or browsing the Service, registering an account, posting a question or answer in our community forum, subscribing to our newsletter, or clicking through to a third party retailer from our Service, you acknowledge that you have read, understood, and agree to be bound by all of the terms and conditions of this agreement. If you do not agree with all of the provisions of these Terms, you are expressly prohibited from using the Service and you must discontinue use immediately.

Supplemental terms and conditions or documents that may be posted on the Service from time to time are hereby expressly incorporated into these Terms by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason, as further described in the section titled Amendments to Terms below.

2. Eligibility and Age Requirement

The Service is intended solely for individuals who are at least eighteen years of age, or the age of legal majority in their jurisdiction of residence if that age is higher than eighteen. By using the Service, you represent and warrant that you meet this age requirement and that you possess the legal authority, right, and capacity to enter into this agreement and to abide by all of the terms and conditions set out herein. If you do not meet this requirement, you must not access or use the Service in any way, including registering an account or posting content in our forum.

3. Description of the Service

Auto Veteran provides automotive repair guides, technical resources, diagnostic reference material, an interactive component glossary, a vehicle identification number lookup tool, and a community question and answer forum where registered users may ask automotive questions and receive answers from other members of the community. The Service also includes a curated shop section that links to third party products, and a newsletter that periodically delivers automotive news, guides, and community highlights to subscribers who have opted in.

We reserve the right to modify, suspend, or discontinue the Service, or any part of it, at any time, with or without notice, and we will not be liable to you or to any third party for any such modification, suspension, or discontinuation.

4. User Accounts and Registration

Certain features of the Service, including posting questions and answers in our forum and receiving personalized content, require you to register for an account. When you register, you agree to provide accurate, current, and complete information, and to maintain and promptly update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password and any credentials that you use to access the Service, and you agree not to disclose your password to any third party. You agree to accept responsibility for all activities that occur under your account. We reserve the right to disable any user account, at any time, in our sole discretion, if we determine that you have violated any provision of these Terms.

5. Communications

By creating an account or subscribing to our newsletter, you agree to receive certain communications from us, which may include newsletters, marketing or promotional materials, service announcements, and other information relevant to your use of the Service. You may opt out of receiving newsletters and marketing communications at any time by following the unsubscribe link included in such communications, by adjusting your notification preferences in your account dashboard, or by emailing us at [email protected]. You may not opt out of essential service related communications, such as messages concerning your account security or changes to these Terms.

6. Affiliate Disclosure

Our Shop section and certain product mentions elsewhere on the Service contain affiliate links to products listed for sale on third party retailer websites. Auto Veteran is a participant in several affiliate marketing programs, including the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon properties, as well as the Impact affiliate network and other affiliate advertising programs that connect us with additional retailers. We earn from qualifying purchases made through these links, at no additional cost to you.

We do not process payments, collect payment card information, store billing addresses, or fulfill orders for any product listed in our Shop section. Every purchase you make after clicking through one of these links is a transaction conducted entirely on the applicable retailer's website, subject exclusively to that retailer's own terms of service, pricing, availability, shipping policies, and return and refund policies. Auto Veteran has no control over, and accepts no responsibility for, the completion, accuracy, or fulfillment of any such transaction. Any dispute, refund request, or warranty claim relating to a product purchased through one of these links must be directed to the retailer, not to Auto Veteran.

7. Contests, Sweepstakes, and Promotions

From time to time we may make available contests, sweepstakes, giveaways, or other promotions on the Service. Any such promotion, referred to as a Promotion, may be governed by supplemental rules that are separate from these Terms. If you choose to participate in a Promotion, you should review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will govern with respect to that Promotion.

8. User Generated Content

The Service allows you to post, submit, publish, transmit, or otherwise make available certain content, including questions, answers, replies, comments, and related material, collectively referred to as Content. You are solely responsible for the Content that you post through the Service, including its legality, reliability, accuracy, and appropriateness.

By posting Content, you represent and warrant that the Content is yours, that you own it, or that you otherwise possess the necessary rights and licenses to submit it, and that the posting of your Content does not and will not infringe, misappropriate, or violate a third party's intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights.

You retain any and all ownership rights that you may have in your Content. However, by submitting Content through the Service, you grant Auto Veteran a worldwide, non exclusive, royalty free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display such Content in connection with operating and promoting the Service, in any media format and through any media channels now known or hereafter developed. This license continues even if you stop using the Service, to the extent necessary to allow us to continue displaying content that has already been made available to other users, such as forum answers.

We reserve the right, though not the obligation, to monitor, review, edit, remove, or refuse to display any Content, at any time and for any reason, in our sole discretion, including Content that we determine, in our sole judgment, to violate these Terms, to be objectionable, or to expose us or our users to liability.

9. Prohibited Conduct

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Without limiting the foregoing, you agree that you will not:

Violation of this section may result in immediate suspension or termination of your account, in addition to any other remedy available to us at law or in equity, including referral to law enforcement authorities where appropriate.

10. Forum Moderation and Community Guidelines

Our community forum is moderated by Auto Veteran staff and automated systems designed to detect spam, abusive language, and links to disreputable domains. We reserve the right, in our sole discretion and without prior notice, to remove any question, answer, or reply, to suspend or permanently ban any user found to be in violation of these Terms or our community guidelines, and to reject any externally submitted link pending manual review. Decisions made in the course of forum moderation are final.

11. Intellectual Property Rights

Unless otherwise indicated, the Service and all original source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service, excluding Content submitted by users, are owned or licensed by Auto Veteran and are protected by copyright, trademark, and other intellectual property laws of Kenya and other jurisdictions. Except as expressly provided in these Terms, no part of the Service may be copied, reproduced, aggregated, republished, uploaded, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.

12. Copyright Policy and DMCA Notices

We respect the intellectual property rights of others and expect users of the Service to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act, referred to as the DMCA, and with applicable international equivalents.

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that any Content available through the Service infringes your copyright, you may submit a written notification to our designated Copyright Agent at [email protected] with the subject line Copyright Infringement Notice. To be effective, your notification must include substantially the following information:

Upon receipt of a valid notification, we will act expeditiously to remove or disable access to the identified material and will make a good faith attempt to notify the user who posted it. A user who believes that Content they posted was removed in error may submit a counter notification containing the elements required under the DMCA, including a statement of consent to the jurisdiction of the applicable federal court. It is our policy, in appropriate circumstances, to disable or terminate the accounts of users who are determined to be repeat infringers.

You may be held liable for damages, including costs and attorneys fees, if you knowingly and materially misrepresent that Content is infringing in a notification submitted under this section.

The Service may contain links to third party websites, applications, or services that are not owned or controlled by Auto Veteran, including but not limited to Amazon, YouTube, and other reference or retail websites referenced in our guides. We have no control over, and assume no responsibility for, the content, privacy policies, terms of service, or practices of any third party websites or services. You acknowledge and agree that Auto Veteran shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance on, any content, goods, or services available through any such third party website or service. We strongly encourage you to review the terms and privacy policies of any third party website that you visit.

14. Automotive Content Disclaimer

The technical guides, diagnostic information, and repair instructions published on the Service are provided for general informational and educational purposes only and do not constitute professional automotive, mechanical, electrical, or safety advice. Vehicle repair carries inherent risk, and procedures that are appropriate for one vehicle, model year, or trim level may not be appropriate for another. You should always consult your vehicle's official service manual and, where appropriate, a qualified and certified automotive technician before undertaking any repair, modification, or diagnostic procedure described on the Service. Auto Veteran disclaims any and all liability for injury, property damage, or vehicle damage arising from reliance on information published on the Service.

15. Editorial Process

Certain articles and summaries published on the Service are developed by drawing on publicly available automotive news, manufacturer documentation, and reference material. All such content is reviewed by a member of our editorial team prior to publication. Notwithstanding this review process, content may occasionally contain inaccuracies, and you should independently verify any technical specification, safety recall, or repair procedure against your vehicle manufacturer's official documentation before relying on it.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUTO VETERAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUTO VETERAN, NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. WHERE LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW BUT MAY BE LIMITED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS.

18. Indemnification

You agree to defend, indemnify, and hold harmless Auto Veteran and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party, including any intellectual property or privacy right.

19. Termination

We may suspend or terminate your account and your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation a breach of these Terms. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your own account, you may do so at any time through your account dashboard or by contacting us. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

20. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service shall first be submitted to good faith negotiation between the parties, and if not resolved within thirty days, shall be subject to the exclusive jurisdiction of the courts of Kenya. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.

21. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.

22. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of substantially all of our assets.

23. Entire Agreement

These Terms, together with our Privacy Policy and our Disclaimer, constitute the entire agreement between you and Auto Veteran regarding the Service and supersede any prior agreements, whether written or oral, between you and Auto Veteran relating to the Service.

24. Amendments to Terms

We reserve the right, in our sole discretion, to amend these Terms at any time by posting the revised Terms on this page and updating the Last Updated date above. It is your responsibility to review these Terms periodically. Your continued access to or use of the Service following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Service.
